PRIVACY POLICY AND TERMS OF USE
In compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free movement of this data (RGPD), as well as in compliance with Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights (LOPDGDD), the following points related to the treatment are reported below personal data through this website.

PURPOSE OF TREATMENT
From the online training platform, the User will be able to access content, list of contracted courses, access tasks and activities, maintain tutorials, participate in forums, and download documentation related to said courses, among other functionalities. The User must fully comply with the conditions of use of the Virtual Area that have been indicated in the registration process as a registered user.
VERACITY OF THE INFORMATION PROVIDED
It will be the responsibility of the User to verify that the information provided is accurate and complete before making any decision related to any service or content. Likewise, the User will notify the person responsible for the treatment of any modification of their data, in order to keep them updated during all phases of the treatment.
BASIS THAT LEGITIMATE DATA PROCESSING
The basis that legitimizes the processing of data is the correct execution of the contractual relationship between the parties.
DATA CONSERVATION
The information included in the training platform will be kept for the duration of the training action. Subsequently, the information will be kept duly blocked during the legal period of conservation and after said period, it will be deleted.
EXERCISE OF RIGHTS
The RGPD recognizes different rights to the interested party in relation to the processing of their personal data. Below, we inform about each of these rights and indicate the channels through which you can direct, where appropriate, the corresponding request:

- Right of portability: You will have the right to request the portability of your data in a structured, commonly used and machine-readable format. When exercising your right to data portability, you have the right to have personal data transmitted directly from controller to controller where technically feasible.
- Right to object: You have the right to request opposition to data processing, at any time, including profiling. In the event that you exercise this right, the controller will stop processing your personal data, except for compelling legitimate reasons for the processing to prevail over your interests, rights and freedoms, or for the formulation, exercise or defense of claims.

INFORMATION SECURITY
The controller uses technologies appropriate to the current prior art to protect personal data and information and the website is stored on secure servers protected against the most common types of attacks. The controller has adopted technical and organisational measures to ensure the security of personal data and prevent their alteration, loss, processing or unauthorised access, taking into account the state of technology, the nature of the data stored and the risks to which they are exposed. The student's password is personal and non-transferable.
Any fraudulent use of this password and the consequences arising from such improper use will be the full responsibility of its owner, leaving the Training Entity empowered to exercise the legal actions it deems appropriate in defense of its rights. In the event that the user suspects that their access credentials have been accessed by an unauthorized third party, they must contact the Training Entity immediately through the contact area of the platform, in order to adopt the necessary measures and, where appropriate, Reset the access data.
LIMITATION OF ACCESS
CESUR FORMACIÓN reserves the right to deny access to the courses to those participants who show behavior that affects the normal functioning of the class, the forum and carry out activities that violate its code of conduct, such as:
- he dissemination, without the appropriate authorization, of the materials provided in the realization of the courses or programs.
- The use of the username and personal and non-transferable access code by more than one person, causing clear fraud to the Training Entity or the use of username and password of others with the intention of supplanting the identity of a third party.
- Performing activities that violate intellectual property rights.
- The sending of spam using the addresses of the classmates of the training action in which the student participates.
- Acts that are contrary to the right to honor, personal and family privacy or the image of third parties.
- The transmission, dissemination or making available to third parties through the virtual campus, information, messages, graphics, sound and / or image files, photographs, recordings, software and in general any kind of material, data or content that:
- Induce, incite or promote criminal, denigratory, defamatory, violent or, in general, contrary to law, morality and generally accepted good customs or public order;
- incorporate messages that are criminal, violent, pornographic, degrading or, in general, contrary to law, morality and generally accepted good customs or public order;
- Violate the trade secrets of third parties.
OBLIGATIONS AND RESPONSIBILITIES OF THE USER
The student undertakes not to engage in unauthorized activities of access to computer systems, both of the center and of third parties, nor in unauthorized activities of access, alteration or manipulation of information, whether the information belongs to the center or if it belongs to third parties, in accordance with what is indicated in the current regulations on protection of personal data the computer resources that the center makes available in courses On Line.
CESUR FORMACIÓN will not have any responsibility in case of an incorrect installation or configuration of the student's equipment that prevents him from using the virtual campus, nor will he be in charge of the technical service that the student's computer equipment may need for its correct operation. CESUR FORMACIÓN is not responsible for the information and content stored, by way of example, but not limited to, in forums, chats, blog generators, comments, social networks or any other means that allow third parties to publish content independently on this platform. However, and in compliance with the provisions of art. 11 and 16 of Law 34/2002, of July 11, Services of the Information Society and Electronic Commerce (LSSI-CE), the provider is available to all users, authorities and security forces, and actively collaborating in the withdrawal or, where appropriate, blocking of all content that could affect or contravene national legislation, or international, rights of third parties or morality and public order. In the event that the User considers that there is, on the platform, any content that could be susceptible to this classification, please notify us immediately.
CHANGES TO THIS PRIVACY POLICY
The data controller reserves the right to modify this Privacy Policy to adapt it to new legislation or jurisprudence, as well as industry practices. In such cases, the controller shall announce the changes introduced reasonably in advance of their implementation.
DISPUTE RESOLUTION
In case of dispute, the parties expressly submit to Spanish legislation and to the courts and tribunals of the user's domicile, when he has the status of consumer. Otherwise, the parties, expressly waiving the jurisdiction that may correspond to them, submit to the courts and tribunals of Malaga.
